Attorneys for the Dayton area’s only abortion clinic are continuing to fight to keep the facility open, despite the Ohio Supreme Court’s refusal to hear their latest appeal last month.

The Ohio Supreme Court won't hear an Ohio abortion clinic's challenge to the state's increasingly stringent operational rules, placing the facility's future in question even as it remains open for now.

Efforts to convince Dayton health systems to sign a state-mandated patient transfer agreement with the Miami Valley’s last abortion clinic remain unsuccessful, despite increased pressure from some politicians, and an ongoing petition campaign.

Clinic officials say without such an agreement, the facility may close.

The U.S. Supreme Court declined to take up an appeal of an Alabama law that bans dilation and evacuation abortions, the method most commonly used in the second trimester. That means a lower court ruling, which said the ban was unconstitutional, will stand.

The Dayton City Commission is urging Dayton’s two major health-care systems to sign a transfer agreement with the Miami Valley’s last-remaining abortion provider.

The agreement is required by state law. And without it, the clinic is in danger of closing.

Among the city commission members, four out of five voted in favor of the resolution asking Kettering Health Network and Premier Health to sign the transfer agreement with Women’s Med Center in Kettering.

Legal efforts to challenge the state requirement have so far been unsuccessful.
