Second Lawsuit Filed Against Chipotle After 700 Potentially Sickened

Another lawsuit been filed against Chipotle Mexican Grill on Monday morning, after hundreds reported being sickened after eating at the chain's Powell location.

According to Delaware County Court records, the plaintiff consumed Chipotle on July 27 and began feeling sick the next morning, experiencing diarrhea, vomiting, severe abdominal pain, dizziness, nausea and headaches. The plaintiff is seeking $25,000 in damages.

The lawsuit followed another suit suit filed last Tuesday.

Ron Simon & Associates — the law firm representing the plaintiff — released a statement saying that this suit would be the first of many lawsuits they will file on behalf of those potentially sickened by Chipotle's food.

"We will not allow Chipotle to sweep this disaster under the rug and we strongly encourage all victims to seek legal advice before contacting Chipotle or its lawyers," said lead attorney Ron Simon in the statement.

The Chipotle, located on 9733 Sawmill Parkway, was initially closed on Monday, July 30 after hundreds of customers reported illness. It was cleared to reopen the next day. By Friday, the number of complaints had reached 703.

No reports of illness have been made since the Chipotle reopened.

The Delaware County General Health District said on Friday that they had eliminated the possibilities of Salmonella, Shigella, E.coli and Norovirus as the cause, but had not yet determined the exact food-borne illness.

Anyone who consumed food from Chipotle between July 26-30 and experienced sickness is encouraged to contact the Delaware General Health District.
